EXEMPTION FROM SECTION 605.30 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt pilots-in-command from the requirement of section 605.30 of the Canadian Aviation Regulations (CARs). This exemption is subject to the condition below.

Section 605.30 of the CARs states that no person shall conduct a take-off or continue a flight in an aircraft where icing conditions are reported to exist or are forecast to be encountered along the route of flight unless

1. The pilot-in-command determines that the aircraft is adequately equipped to operate in icing conditions in accordance with the standards of airworthiness under which the type certificate for that aircraft was issued; or
2. Current weather reports or pilot reports indicate that icing conditions no longer exist.

PURPOSE

The purpose of this exemption is to authorize the pilots-in-command (PIC) to conduct a take-off or continue a flight in an aircraft where icing conditions are forecast to be encountered along the route of flight, without the aircraft being adequately equipped to operate in icing conditions, in accordance with the standards of airworthiness under which the aircraft type approval document was issued, while conforming to the condition of this exemption.

APPLICATION

This exemption applies to PICs who wish to conduct a take-off or continue a flight where icing conditions are forecast to be encountered along the route of flight without the aircraft being adequately equipped to operate in icing conditions.

CONDITION

This exemption is subject to the following condition:

1. The PIC shall ensure that current weather reports, pilot reports, or briefing information relied upon by the PIC indicate that the forecast icing conditions that would otherwise prohibit the flight will not be encountered during the flight because of changed weather conditions since the forecast.

VALIDITY

This exemption is in effect until the earliest of:

1. 23:59 EDT on April 14^th 2007;
2. The date on which amendments to the appropriate provisions of the CARs come into effect;
3. The date on which the condition set out in this exemption is breached; or
4. The date on which this exemption is canceled in writing by the Minister where he is of the opinion it is no longer in the public interest or that it is likely to affect aviation safety.
